# EP01 — Buy, Borrow, Die: The Tax Code the Rich Wrote

**Series:** GOP Brand Of Socialism Is Bad For America
**Episode:** 01 of 53 (OPENER — Kirk's order: 2 3 1 4 5)
**Tier:** D* — the tax-code thesis. Lane: **"welfare for the connected"**, never "socialism."
**Thesis line (SERIES_DOCTRINE §0):** *Socialism for the well-connected. Capitalism for the poor.*

## HOOK (cold open, receipt-first)

"How did the richest man in the world pay zero federal income tax? He didn't break a single law. The law was written for him."

## THESIS

There is one system for the connected and another for you. You pay ordinary income
tax on every dollar you earn. The ultrawealthy borrow against their assets instead
of selling them — loans aren't income, so they aren't taxed. Then they die holding
the assets, and the step-up in basis **erases the capital gain forever**. Buy.
Borrow. Die. It is not a loophole. It is the architecture.

## RECEIPTS (verbatim, sourced, L1-admitted)

- **The strategy has a name.** USC tax law professor Edward McCaffery: "summarized the entire arc with the catchphrase buy, borrow, die."
  - ProPublica, The Secret IRS Files (June 8 2021)
- **Death erases the gain.** "Any capital gains till that moment are not taxed. This allows the ultrarich and their heirs to avoid paying billions in taxes. The step-up in basis is widely recognized by experts across the political spectrum as a flaw in the code."
  - ProPublica, same
- **Loans aren't income.** "take out a loan... you'll pay a single-digit interest rate and no tax; since loans must be paid back, the IRS doesn't consider them income."
  - ProPublica, same
- **The two systems, side by side.** "the median American household earned about $70,000 annually and paid 14% in federal taxes. The highest income tax rate, 37%, kicked in this year, for couples, on earnings above $628,300. The confidential tax records obtained by ProPublica show that the ultrarich effectively sidestep this system."
  - ProPublica, same
- **The face.** Bezos 2014–2018: wealth growth $99.0B, income reported $4.22B (4.26% of wealth), taxes paid $973M (0.98% of wealth).
  - ProPublica, same
- **Zero, named.** Musk paid no federal income tax in 2018; Bloomberg in recent years; Icahn twice; Soros three years in a row; Bezos in 2007 and 2011.
  - ProPublica, same
- **Their own words.** Carl Icahn: "if you're a poor person, a rich person, if you are Apple — if you have no income, you don't pay taxes."

## DESPINNING ARC

- **OPEN:** Zero tax. No crime. The law.
- **NAME THE WORD:** They call the other side "socialists." Define the mechanism. This isn't socialism — it's *welfare for the connected*.
- **THE RECEIPT:** Buy / Borrow / Die, each stage sourced.
- **THE SIDE-BY-SIDE:** You, 14% of $70k. Bezos, 0.98% of $99B. Same country.
- **THE STEELMAN:** "They paid what they owed; the code is legal; wealth isn't income." (Air straight.)
- **THE REBUTTAL:** A system you designed to never be taxed isn't "paying what you owe" — it's writing your own bill. And the step-up was called "a flaw in the code... by experts across the political spectrum."
- **CLOSE — the thesis, verbatim:** *Socialism for the well-connected. Capitalism for the poor.*

## ON-AIR RULES

- NEVER call Buy/Borrow/Die "socialism." Its lane is **"welfare for the connected."** Different crime, same courtroom: theft of the tax base.
- Name the mechanism (borrow ≠ income; step-up erases gain), not just the outrage.
- Attribute every figure to ProPublica, The Secret IRS Files.
- The steelman is aired straight, then rebutted with the mechanism.
